If successful, the First-tier Tribunal (FTT) may grant a Wrongful Termination Order (WTO). The current maximum a landlord can be ordered to pay a former tenant is a sum equivalent to six times the monthly rent charge immediately before the tenancy ended.<\/p>\n<p>From <strong>6<sup>th<\/sup> October 2026<\/strong> the law will change and potential financial awards will be significantly higher. Amendments mean the FTT will calculate awards in multiples of the \u2018relevant sum\u2019 rather than the rent charge. The relevant sum will be either the rental charge\u00a0or\u00a0\u00a3840, whichever is the <u>higher<\/u> amount.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/housing-scotland-bill-what-the-new-housing-bill-means-for-landlords\/rentlocally-dec-25\/\" rel=\"attachment wp-att-58703\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-58703\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2025\/12\/rentlocally-dec-25.jpg\" alt=\"\" width=\"1000\" height=\"667\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2025\/12\/rentlocally-dec-25.jpg 1000w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2025\/12\/rentlocally-dec-25-700x467.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2025\/12\/rentlocally-dec-25-400x267.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2025\/12\/rentlocally-dec-25-768x512.jpg 768w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/a><\/p>\n<h2>Maximum Award<\/h2>\n<p>If the FTT determines a WTO should be made, the maximum award will be set at 36 times the relevant sum; a staggering \u00a330,240 (or other sum if the rent charge &gt;\u00a3840)). The exact sum awarded will be determined by the FTT taking into account the manner of the wrongful termination and the impact on the tenant.<\/p>\n<p>For example, in the recent case of FTS\/HPC\/PR\/25\/2854 the FTT considered the facts demonstrated breach at the \u201cmore serious end of the scale\u201d and awarded 5 x the rent charge (\u00a3850) against the landlord, totalling \u00a34,250.\u00a0 An award of 5 x rent represents 83.3% of the current maximum penalty. This would equate to 30 x the relevant sum and an award of approximately \u00a325,500 under the new provisions.<\/p>\n<h2>Minimum Award<\/h2>\n<p>The legislation will also stipulate a minimum level of three times the relevant sum \u00a32,530 (or other sum if the rent charge &gt;\u00a3840).<\/p>\n<p>An award lower than the minimum level can be made if the FTT considers it appropriate having regard to all the circumstances but nonetheless, the changes mark a significant increase to a landlord\u2019s potential maximum liability.<\/p>\n<p>Landlords will often have a legitimate explanation and a genuine change in circumstances. WTO proceedings can be defended on that basis.
