Not so with one East Sussex tenant and his landlord. Colin Gregory, former antiques dealer, managed to prevent the property being sold on and secured cheap rent on it through the courts for the next 90 years.<\/p>\n<h4><strong>Living in harmony<\/strong><\/h4>\n<p>Sheila and David Harding bought their friend and next door neighbour Mr Gregory\u2019s three bedroom bungalow in Broomfield Avenue, Peacehaven in 2001 after finding out he was struggling with his mortgage. The couple used a \u2018buy to rent\u2019 mortgage to finance the \u00a3143,000 purchase and help their friend out so that he did not have to move out. A rental agreement was signed and Mr Harding assured his friend he could stay in the property \u201cfor as long as feasibly possible\u201d. He also promised to keep the rent at \u00a3800 \u201cfor as long as he could afford it\u201d.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/one-good-property-deed-deserves\/bungalow\/\" rel=\"attachment wp-att-7572\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-7572\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/08\/bungalow.jpg\" alt=\"\" width=\"1920\" height=\"1280\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/08\/bungalow.jpg 1920w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/08\/bungalow-700x467.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/08\/bungalow-1100x733.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/08\/bungalow-400x267.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/08\/bungalow-768x512.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/08\/bungalow-1536x1024.jpg 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><\/a><\/p>\n<h4><strong>Unexpected turn of events<\/strong><\/h4>\n<p>A year later, in 2002, Mr &amp; Mrs Harding moved to Spain. In 2014 they decided to sell their property in Broomfield Avenue which was then valued at \u00a3310,000. They first offered it back to Mr Gregory for \u00a360,000 less that the valuation and gave him one year to secure the money. However, Mr Gregory declined the offer and refused to leave the house.<\/p>\n<p>The couple then managed to find a buyer who was prepared to pay \u00a3240,000 for the <a href=\"https:\/\/www.citylets.co.uk\/\">property<\/a> and keep Mr Gregory as a tenant, however, at a higher rent of \u00a31,200 a month. When Mr Gregory objected to the rent increase, in May 2016 the case went to Brighton County Court, where Mr Gregory said he sold the house to the Hardings at a reduced price on the basis he could rent it for as long as he wanted.<\/p>\n<p>\u201cWe had a paper agreement stating that I could stay in the house for as long as I want for \u00a3800 a month, with a mortgage payment included in the rent\u201d, said Mr Gregory.<\/p>\n<p>However, Mr &amp; Mrs Harding strongly disputed that claim as not mentioned in the tenancy agreement.<\/p>\n<h4><strong>92 year old law that \u201cnobody had heard of\u201d<\/strong><\/h4>\n<p>In Mr Gregory\u2019s defence, his solicitor cited the 1925 Property Act and a case known as Bannister v Bannister 1948 where a woman was given the right to live rent free for life in a cottage she sold to her brother for under market value.<\/p>\n<p>The judge ruled in Mr Gregory\u2019s favour, granting him the right to pay cheap rent for the next 90 years and ordered the Hardings to pay Mr Gregory\u2019s costs of \u00a311,000. The couple also heard they couldn\u2019t sell the property unless a person buying it would keep Mr Gregory as a tenant at \u00a3800 fixed rent.<a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" rel=\"attachment wp-att-2791\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>Mr Harding said: \u201cWe tried to help out, not only as a good neighbour and <a href=\"https:\/\/www.citylets.co.uk\/landlord-services\/\">landlord<\/a>, but we considered Colin a good friend.\u201d<\/p>\n<p>\u201cWe went into court told by our solicitors that there would be no problem and walked out with him winning the case and us owing him costs. It\u2019s ludicrous.\u201d<\/p>\n<p>\u201cWe want to warn other people who are thinking of entering into any kind of agreement like this. We did everything by the book and look where it ended up.\u201d<\/p>\n<p>Mr &amp; Mrs Harding were not given permission to appeal and Mr Gregory&#8230;?
