A few months after moving in she started to struggle with rent payments which resulted in arrears of \u00a32,000. The landlord served the tenant <a href=\"https:\/\/www.citylets.co.uk\/blog\/ending-the-tenancy\/\">notice to leave<\/a> and she vacated the property at the end of the 12 month tenancy.<\/p>\n<h4><strong>Controversial advice<\/strong><\/h4>\n<p>However, when she was denied rehousing options by the council due to the fact she had voluntarily made herself homeless, she returned to the managing agent asking if she could move back into the property. She was advised by the council at that point that she should have stayed in the property until evicted and if the agent refused returning the keys, she should break back in and change the locks.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/council-advises-tenant-to-break-back-into-flat\/lock-opening\/\" rel=\"attachment wp-att-7625\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-7625\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/01\/lock-opening.jpg\" alt=\"\" width=\"1920\" height=\"1442\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/01\/lock-opening.jpg 1920w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/01\/lock-opening-700x526.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/01\/lock-opening-1100x826.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/01\/lock-opening-400x300.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/01\/lock-opening-768x577.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/01\/lock-opening-1536x1154.jpg 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><\/a><\/p>\n<p>When the agent went to the property the morning after, he was surprised to learn that his keys no longer worked and furniture had been moved back in.<\/p>\n<p>\u201cIn an attempt to resolve the matter, I drove straight to the local council but no-one would speak to me or identify who had issued such ludicrous advice to a tenant who felt she had no choice but to break the law\u201d, said property manager for the landlord, Robert Gordon.<\/p>\n<h4><strong>Council\u2019s statement<\/strong><\/h4>\n<p>Since then the council has spoken and stood by its decision: \u201cThe client reached out to staff at the Public Advice and Service Centre (PASC), where she was informed she still had a number of months in the property, as the landlord would need to follow the legal eviction process.\u201d<\/p>\n<p>The council\u2019s spokesperson confirmed the tenant was advised \u201cto return to the property as she still had the right of occupation\u201d and the agent was \u201creminded that as the case had not gone through the courts, the client had the legal right to remain in the property\u201d.<a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" rel=\"attachment wp-att-2791\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>\u201cHavering Council will always do its best to support vulnerable residents from becoming homeless, and we urge both private landlords and letting agents to act responsibly and follow the correct legal procedures\u201d &#8211; said the spokesperson.<\/p>\n<h4><strong>Evicting the tenant<\/strong><\/h4>\n<p>The landlord has decided not to take legal action against the tenant under a trespassing law, but instead served a Section 21 notice and a Section 8 notice to regain possession of his property and recover money owed, which can take up to eight weeks. Even then, the tenant can refuse to leave and then bailiffs will have to be called.<\/p>\n<p>The frustrated landlord commented: \u201cNot only am I not receiving rent on my property, I\u2019m now faced with eviction costs and yet I\u2019m powerless to do anything about it.\u201d<\/p>\n<p>\u201cThe agent has done everything possible to protect my interests but landlords and agents are facing a losing battle if local authorities are going to issue such ridiculous advice.\u201d<\/p>\n<p>Paul Shamplina, founder of the eviction firm, <a href=\"https:\/\/www.landlordaction.co.uk\/\">Landlord Action<\/a>, said: \u201cLocal authorities are forcing landlords to go to court to gain possession, running up considerable costs.\u201d<\/p>\n<p>He continued: \u201cLandlords are losing confidence in the system and turning away from communities which rely on their private housing to bridge the gap in the chronic shortage of social housing.\u201d<\/p>\n<p>\u201cThis advice is exasperating the problem and something needs to be done.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Havering Council advised a tenant to break back into the property she had vacated just 24 hours earlier on the basis \u201cshe still had the right of occupation\u201d.
