As a housing benefit claimant she was, however, refused to be considered. When her letter of complaint was dismissed, Rosie issued a claim for discrimination in the county court.<\/p>\n<p>\u201cIt made me feel like a second-class citizen\u2026 I felt something had to be done to challenge it. I was motivated by anger at such inequitable practice,\u201d said the cleaner and former paralegal.<\/p>\n<p><strong>\u201cPreventing good tenants from accessing the private rented sector\u201d<\/strong><\/p>\n<p>Rosie successfully managed to argue that the agent\u2019s blanket ban on benefit claimants indirectly discriminated against women and single women in particular. She won a compensation for sex discrimination, to which the agent admitted and settled out of court with \u00a32,000.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/do-state-benefits-equate-to-second-class-citizens-in-renting\/pound-coin\/\" rel=\"attachment wp-att-7633\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-7633\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/03\/pound-coin.jpg\" alt=\"\" width=\"1920\" height=\"1280\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/03\/pound-coin.jpg 1920w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/03\/pound-coin-700x467.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/03\/pound-coin-1100x733.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/03\/pound-coin-400x267.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/03\/pound-coin-768x512.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2018\/03\/pound-coin-1536x1024.jpg 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><\/a><\/p>\n<p>Rose Arnall, legal officer in Shelter who supported Rosie\u2019s case commented: \u201cWomen are more likely to be caring for children and therefore working part-time and are therefore more likely to top up their income by claiming housing benefit.\u201d<\/p>\n<p>She added: \u201cBy applying a blanket policy they [landlords] are actually preventing good tenants from accessing the private rented sector.\u201d<\/p>\n<p><strong>Landlords with \u2018no DSS\u2019 policy breaking equality laws?<\/strong><\/p>\n<p>Landlords and agents who don\u2019t accept housing benefit tenants may be breaking equality law after Rosie\u2019s legal case and Shelter is urging them all to get rid of <a href=\"https:\/\/www.citylets.co.uk\/blog\/no-dss-whose-choice-is-it-anyway-banks-or-landlords\/\">&#8216;no DSS&#8217;<\/a> policies and treat everyone fairly on a case-by-case basis.<\/p>\n<p>However, the figures show the number of landlords willing to rent to housing benefit tenants is falling each year. According to Shelter\u2019s survey of 1,137 landlords conducted in 2017, 43% had an outright ban on letting to housing benefit claimants, with further 18% preferring not to let to them.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" rel=\"attachment wp-att-2791\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>Chris Norris, head of policy at the <a href=\"https:\/\/www.landlords.org.uk\/\">National Landlords Association<\/a>, explained that \u201ccuts to welfare and problems with the universal credit system are making it more and more difficult for anyone in receipt of housing support to pay their rent on time and sustain long-term tenancies.\u201d<\/p>\n<p><strong>Landlords\u2019 voice<\/strong><\/p>\n<p>A council accredited landlord said: &#8220;I can safely say that the &#8220;no DSS&#8221; is not down to landlord preference or discrimination&#8230; it&#8217;s entirely down to (a.) mortgage terms and (b.) severe delays in the claimants HB claim, <a href=\"https:\/\/www.citylets.co.uk\/blog\/changing-times-universal-credit\/\">universal credit<\/a> policy to pay claimants directly into their bank account.\u201d<\/p>\n<p>Another one admitted that it was his landlord insurance policy that stopped him from renting to housing benefit claimants.<\/p>\n<p>&nbsp;<\/p>\n<p>[gravityform id=&#8221;2&#8243; title=&#8221;true&#8221; description=&#8221;false&#8221;]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>That\u2019s how a single mum, Rosie Keogh, felt when a letting agency rejected her application because she was on state benefit.
