In this first of its kind Tribunal decision, the tenant was granted \u00a318,000.<\/p>\n<p>Dambaru Baral raised a case against his landlords, Mohammed and Khalda Arif, in September 2018 after he was evicted from his rented <a href=\"https:\/\/www.citylets.co.uk\/flats-rent-glasgow\/\" target=\"_blank\" rel=\"noopener noreferrer\">flat in Glasgow<\/a> back in 2015.<\/p>\n<h4><strong>Changing locks<\/strong><\/h4>\n<p>In December 2013, Mr Baral entered into a short assured tenancy with Zahad Arif, who acted as a representative for the landlords.<\/p>\n<p>Two years into the lease, Zahad Arif and another person (Mr Bhatti) entered the property without a prior warning when the tenant was away. They removed Mr Baral\u2019s belongings and changed the locks due to the tenant allegedly being in <a href=\"https:\/\/www.citylets.co.uk\/blog\/rent-overdue-advice-for-landlords\/\" target=\"_blank\" rel=\"noopener noreferrer\">rent arrears<\/a> (the exact amount of which was disputed).<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/unlawfully-evicted-tenant-awarded-18k\/brown-box\/\" rel=\"attachment wp-att-4858\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-4858\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/01\/brown-box.jpg\" alt=\"\" width=\"867\" height=\"578\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/01\/brown-box.jpg 1350w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/01\/brown-box-700x467.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/01\/brown-box-1100x733.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/01\/brown-box-400x267.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/01\/brown-box-768x512.jpg 768w\" sizes=\"auto, (max-width: 867px) 100vw, 867px\" \/><\/a><\/p>\n<p>Despite Mr Arif claiming he had an verbal agreement with Mr Baral that he would vacate the property at the end of November 2015, neither party had taken formal steps to <a href=\"https:\/\/www.citylets.co.uk\/blog\/ending-the-tenancy\/\" target=\"_blank\" rel=\"noopener noreferrer\">terminate the tenancy<\/a>.<\/p>\n<p>In an earlier hearing it was established that Mr Arif didn\u2019t have a court order when he was taking possession of the property on the defence he believed or had a reasonable cause to believe that the tenant had ceased to occupy the rented accommodation. Mr Arif claimed the property appeared abandoned and carried on with the eviction even after the tenant returned to the flat and stated he was still living there.<\/p>\n<h4><strong>Not a \u2018reasonable view\u2019?<\/strong><\/h4>\n<p>The Tribunal rejected the defence that there had been reasons to believe the property was vacated, stating: \u201cMr Arif and Mr Bhatti accepted that they had gone to the flat and filled a number of cardboard boxes with the applicant\u2019s belongings.<\/p>\n<p>\u201cThe record taken by City Building (\u2026) was that there were seven boxes. It is also apparent, from the photographs taken by the applicant, that there were items on top of the boxes.<\/p>\n<p>\u201cOn any reasonable view, the sheer volume of the applicant\u2019s belongings at the tenancy were not such as to indicate that he had ceased occupation.\u201d<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" rel=\"attachment wp-att-2791\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>The Tribunal also took the view it \u201cseemed inherently unlikely\u201d that the tenant had previously agreed to leave the property, \u201cgiven that he had nowhere else to go.\u201d It was accepted at the hearing that Mr Baral had sought advice from the police as to whether he could be evicted without a court order and that he advised Mr Arif he wouldn\u2019t leave without an order being obtained.<\/p>\n<p>\u201cEven if there had been some prior suggestion that he would leave, that conversation ought to have made it clear, to Mr Arif, that the applicant had not agreed to cease occupation,\u201d concluded the Tribunal.<\/p>\n<p>Provided that an unlawful eviction had taken place, the Tribunal awarded \u00a318,000 in damages based on a surveyor\u2019s reports.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A tenant who was found to have been unlawfully evicted has been awarded damages by the First-tier Tribunal for Scotland Housing and Property Chamber.
