{"id":5252,"date":"2020-07-16T09:29:41","date_gmt":"2020-07-16T09:29:41","guid":{"rendered":"https:\/\/www.citylets.co.uk\/blog\/?p=5252"},"modified":"2020-07-16T10:07:11","modified_gmt":"2020-07-16T10:07:11","slug":"scottish-rent-controls-parked-for-now","status":"publish","type":"post","link":"https:\/\/www.citylets.co.uk\/blog\/scottish-rent-controls-parked-for-now\/","title":{"rendered":"Scottish Rent Controls Parked for Now"},"content":{"rendered":"<p>The Fair Rents (Scotland) Bill to control rent levels in the private rented sector was introduced to the Scottish Parliament on June 1st, however, it did not progress to the first stage of consideration.<\/p>\n<p>The Bill, dubbed the Mary Barbour Bill after the legendary rent strike organiser from the early part of the 20<sup>th<\/sup> century, was abandoned by the Local Government and Communities Committee on the basis that, due to a heavy workload, there was not enough time to properly scrutinise it before the next year\u2019s Scottish Parliament elections.<\/p>\n<h4><strong>Measures proposed in the Fair Rents (Scotland) Bill<\/strong><\/h4>\n<p>Written with the support of Govan Law Centre and introduced by Scottish Labour MSP <a href=\"https:\/\/www.citylets.co.uk\/blog\/lets-talk-with-labour-msp-pauline-mcneill\/\" target=\"_blank\" rel=\"noopener noreferrer\">Pauline McNeill<\/a>, the proposals in the Fair Rents (Scotland) Bill mainly included:<\/p>\n<ul>\n<li>a cap on rent increases for Private Residential Tenancies at one percentage point above the annual Consumer Prices Index<\/li>\n<li>a right for private tenants to apply for a fair rent to be determined no more than once in any 12 month period<\/li>\n<li>a requirement for private landlords to disclose rents charged by them when they register or renew their registration on the Scottish Landlord Register.<\/li>\n<\/ul>\n<p>The Bill also instigated a three year review by the Scottish Government to judge how effective its measures were.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/scottish-rent-controls-parked-for-now\/scottish-parliament\/\" rel=\"attachment wp-att-5254\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-5254\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/07\/scottish-parliament.jpg\" alt=\"\" width=\"972\" height=\"507\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/07\/scottish-parliament.jpg 1638w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/07\/scottish-parliament-700x365.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/07\/scottish-parliament-1100x574.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/07\/scottish-parliament-400x209.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/07\/scottish-parliament-768x400.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2020\/07\/scottish-parliament-1536x801.jpg 1536w\" sizes=\"auto, (max-width: 972px) 100vw, 972px\" \/><\/a><\/p>\n<p>James Dornan MSP, Convener of the Committee said: \u201cWe recognise the effort from Scottish Labour MSP Pauline McNeill\u00a0in bringing forward this Bill. However, the committee has finite time available for scrutiny, particularly given our pressing need to investigate the devastating impact of COVID-19 on local government and our wider communities. Given the limited time at our disposal, we felt we could not give this Bill the detailed scrutiny it deserved and so as a committee we decided not to proceed on this occasion.\u201d<\/p>\n<p>Expressing her disappointment with the Committees\u2019 decision, Pauline McNeill MSP said: \u201cI appreciate that time is tight between now and the end of this parliamentary session, but the Bill proposed important measures to protect renters and improve housing affordability. The need for these measures was great before the Covid-19 crisis but lockdown has intensified the need for change in this sector.\u201d<a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" rel=\"attachment wp-att-2791\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>She added: \u201cI believe so strongly in the need for this legislation, I will be seeking to have the Bill scrutinised by one of the other parliamentary committees.\u201d<\/p>\n<h4><strong>\u201cMisdirected timing\u201d<\/strong><\/h4>\n<p>Daryl McIntosh, <a href=\"https:\/\/www.arla.co.uk\/scotland.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">ARLA<\/a> Propertymark\u2019s Strategic Development Manager said that lodging such Bill during the middle of the COVID-19 crisis \u201cwas probably misdirected timing.\u201d<\/p>\n<p>He continued: \u201cIn the last few months, there has been an abundance of new legislation affecting the private rented sector.
