{"id":5747,"date":"2021-05-11T09:45:04","date_gmt":"2021-05-11T09:45:04","guid":{"rendered":"https:\/\/www.citylets.co.uk\/blog\/?p=5747"},"modified":"2021-05-11T09:45:05","modified_gmt":"2021-05-11T09:45:05","slug":"rent-controls-ruled-unlawful","status":"publish","type":"post","link":"https:\/\/www.citylets.co.uk\/blog\/rent-controls-ruled-unlawful\/","title":{"rendered":"Rent Controls Ruled Unlawful"},"content":{"rendered":"<p>One of the most controversial and debated pieces of legislation in recent years, has been ruled unconstitutional by Germany\u2019s highest court. A cap introduced in February 2020 to combat soaring rents in Berlin, violated the Basic Law and as such was unlawful, in the view of the Federal Constitutional Court in Karlsruhe.<\/p>\n<p>The rent cap is reported to have affected 90% of properties in Berlin (1.5m), for which rents had been frozen for five years at their June 2019 level. Any existing rents which were defined as excessive at the time, had to be reduced too. Past 2025, any rent increases would have been limited to 1.3% per year in line with inflation.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/rent-controls-ruled-unlawful\/berlin-siegessaule\/\" rel=\"attachment wp-att-5751\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-5751\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/05\/berlin-siegessaule.jpg\" alt=\"\" width=\"846\" height=\"564\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/05\/berlin-siegessaule.jpg 1920w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/05\/berlin-siegessaule-700x467.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/05\/berlin-siegessaule-1100x733.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/05\/berlin-siegessaule-400x267.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/05\/berlin-siegessaule-768x512.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/05\/berlin-siegessaule-1536x1024.jpg 1536w\" sizes=\"auto, (max-width: 846px) 100vw, 846px\" \/><\/a><\/p>\n<p>However, Berlin\u2019s rent controls policy had come under the attacks from its opponents who claimed that it deterred investors from building new homes, fuelling demand for existing stock and ultimately having a detrimental effect on tenants.<\/p>\n<p>There have also been reports of landlords increasingly introducing a shadow rent clause in tenancy agreements, binding renters to pay an increased price in the event of the court\u00a0abolishing the rent controls policy.<\/p>\n<p>Now that this scenario has materialised, many renters face the prospect of paying backdated rent.<\/p>\n<p><strong>The Fair Rents (Scotland) Bill <\/strong><\/p>\n<p>The ruling on Berlin\u2019s rent cap policy comes as a huge blow for supporters of a <a href=\"https:\/\/www.citylets.co.uk\/blog\/scottish-rent-controls-parked-for-now\/\" target=\"_blank\" rel=\"noopener noreferrer\">blanket restriction on mid-tenancy rent increases<\/a> in the Scottish Private Rented Sector.<\/p>\n<p>The Fair Rents (Scotland) Bill was first introduced before the Scottish Parliament in June 2020, however, due to concerns about there not being sufficient time for the Bill to complete its progression through parliament before the May elections, it was rejected by the Local Government and Communities Committee. However, following political pressure, a consultation into the Fair Rents (Scotland) Bill was held in October 2020.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/eviction-ban-in-scotland-extended\/scottish-parliament-2\/\" rel=\"attachment wp-att-5570\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-5570\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/01\/Scottish-Parliament.jpg\" alt=\"\" width=\"833\" height=\"625\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/01\/Scottish-Parliament.jpg 1920w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/01\/Scottish-Parliament-700x525.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/01\/Scottish-Parliament-1100x825.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/01\/Scottish-Parliament-400x300.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/01\/Scottish-Parliament-768x576.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/01\/Scottish-Parliament-1536x1152.jpg 1536w\" sizes=\"auto, (max-width: 833px) 100vw, 833px\" \/><\/a><\/p>\n<p>In a formal response to the consultation, Propertymark who doesn\u2019t agree with the overall policy aim to control rent levels in the private rented sector, highlighted that the policy could lead to a reduction in supply and have a negative impact on housing quality.<\/p>\n<p><a href=\"https:\/\/www.propertymark.co.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">Propertymark<\/a> also raised concerns that the proposals set out in the Bill, could have unintended consequences, namely landlords who would have otherwise not increased rents, may feel that they now have \u2018permission\u2019 to do so on an annual basis, as the Bill introduces a principle of a once-a-year increase.<\/p>\n<h4><strong>Reform of existing Rent Pressure Zones<\/strong><\/h4>\n<p>Now that the Scottish National Party has won the elections, ARLA Propertymark&#8217;s Daryl McIntosh, Policy Manager for Scotland, Wales and Northern Ireland, believes that the party\u2019s priorities will be to reform the existing Rent Pressure Zone legislation under the Private Housing (Tenancies) (Scotland) Act 2016, to introduce some form of rent control to meet with their pre-election promises.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" target=\"_blank\" rel=\"attachment noopener wp-att-2791 noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>Mr McIntosh said: \u201cThe message from the SNP manifesto for the 2021 election was for the introduction of a new Housing Bill, introduced early in the next parliament to provide greater protection from unreasonable rent increases.<\/p>\n<p>\u201cThere remains very little evidence that capping rents provides for a successful PRS, all indicators pointing the opposite way, with landlords poised to withdraw investment leading to a diminished supply of private sector housing adding more pressure for an already short supply of social housing.<\/p>\n<p>\u201cThere appears to be a notion all landlords are privileged, extracting rents from tenants in pursuit of financial gain.
