{"id":5886,"date":"2021-08-26T09:10:31","date_gmt":"2021-08-26T09:10:31","guid":{"rendered":"https:\/\/www.citylets.co.uk\/blog\/?p=5886"},"modified":"2021-08-26T09:10:31","modified_gmt":"2021-08-26T09:10:31","slug":"pre-eviction-protocols-to-be-made-permanent-post-pandemic","status":"publish","type":"post","link":"https:\/\/www.citylets.co.uk\/blog\/pre-eviction-protocols-to-be-made-permanent-post-pandemic\/","title":{"rendered":"Pre-Eviction Protocols to Be Made Permanent Post-Pandemic?"},"content":{"rendered":"<p>One of the temporary measures introduced by the Scottish Government in response to the Coronavirus pandemic was pre-action requirements that landlords and agents in the private rented sector must comply with prior to seeking repossession of a property for rent arrears that have occurred during the Covid-19 period.<\/p>\n<p>The Rent Arrears Pre-Action Requirements (Coronavirus) (Scotland) Regulations 2020 came into force last October in order to help landlords and tenants work together to sustain tenancies during the Coronavirus crisis. As such, letting agents and landlords must ensure they engage with tenants who fall behind on their rent and offer them advice and assistance so that <a href=\"https:\/\/www.citylets.co.uk\/blog\/evictions-are-last-resort-reaffirm-landlords\/\" target=\"_blank\" rel=\"noopener noreferrer\">evictions<\/a> can be avoided wherever possible. Documenting such correspondence is vitally important as it will be considered by the First-tier Tribunal for Scotland (Housing and Property Chamber) as part of their discretion in deciding whether to grant an eviction order.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/pre-eviction-protocols-to-be-made-permanent-post-pandemic\/scottish-parliament-close-up\/\" rel=\"attachment wp-att-5890\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-5890\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/08\/scottish-parliament-close-up.jpg\" alt=\"\" width=\"1400\" height=\"933\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/08\/scottish-parliament-close-up.jpg 1920w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/08\/scottish-parliament-close-up-700x467.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/08\/scottish-parliament-close-up-1100x733.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/08\/scottish-parliament-close-up-400x267.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/08\/scottish-parliament-close-up-768x512.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/08\/scottish-parliament-close-up-1536x1024.jpg 1536w\" sizes=\"auto, (max-width: 1400px) 100vw, 1400px\" \/><\/a><\/p>\n<p>As the Scottish Government is now considering making these, as well as some other temporary provisions made under the Scottish and UK Coronavirus legislation permanent, a public <a href=\"https:\/\/consult.gov.scot\/constitution-and-cabinet\/covid-recovery\/\" target=\"_blank\" rel=\"noopener noreferrer\">consultation<\/a> has been launched.<\/p>\n<p>The public can share their views on the proposals set out in the consultation, as well as suggest any additional measures or legislation not covered in the consultation that could support Scotland\u2019s recovery, until November 9.<\/p>\n<h4><strong>Working together through rent arrears<\/strong><\/h4>\n<p>Welcoming the intention to make the Pre-Action Requirements permanent, Jon Sparkes, Chief Executive of Crisis, said: \u201cThese protections can give private tenants more time and support to work through rent arrears.<\/p>\n<p>\u201cWe know that the best way to end homelessness is to prevent it happening in the first place. That means offering people who face the prospect of losing their home help at an early stage and for public services and landlords to work together to provide the assistance they need.\u201d<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" target=\"_blank\" rel=\"attachment noopener wp-att-2791 noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>Deputy First Minister and Covid Recovery Secretary, John Swinney, commented: \u201cThis consultation focuses on reviewing the legislative powers that have supported our response to Covid-19. We want to ensure we remove measures no longer needed in order to respond to the pandemic whilst keeping those where there is demonstrable benefit to the people of Scotland.<\/p>\n<p>He added: \u201cI invite everyone to have their say on what the future should look like to support a fair, safe and secure recovery.
