{"id":5960,"date":"2021-10-08T08:30:45","date_gmt":"2021-10-08T08:30:45","guid":{"rendered":"https:\/\/www.citylets.co.uk\/blog\/?p=5960"},"modified":"2021-10-08T08:30:45","modified_gmt":"2021-10-08T08:30:45","slug":"landlords-change-of-heart-leads-to-2400-fine","status":"publish","type":"post","link":"https:\/\/www.citylets.co.uk\/blog\/landlords-change-of-heart-leads-to-2400-fine\/","title":{"rendered":"Landlord\u2019s \u2018Change of Heart\u2019 Leads to \u00a32,400 Fine"},"content":{"rendered":"<p>A Glasgow landlord has been fined \u00a32,400 for misleading his former tenants into surrendering occupation of a property which they wouldn\u2019t have left otherwise.<\/p>\n<p>Lesley Munro and Grant McNicoll applied to the First-tier Tribunal for Scotland Housing and Property Chamber for a Wrongful Termination Order after their landlord, David Ross served a notice on them to leave their Dennistoun flat in December 2020, giving them until 6<sup>th<\/sup> March 2021 to vacate.<\/p>\n<p>To repossess the property, the landlord used ground 4 of schedule 3 of the Private Housing (Tenancies) (Scotland) Act 2016 claiming that he intended to live in the property. The tenants, however, argued that the <a href=\"https:\/\/www.gov.scot\/publications\/private-residential-tenancies-landlords-guide\/pages\/grounds-for-eviction\/\" target=\"_blank\" rel=\"noopener noreferrer\">ground<\/a> cited by the landlord was bogus given his conduct after they had vacated the property on 13<sup>th<\/sup> January 2021, having found alternative accommodation and serving their own notice to terminate the lease on 18<sup>th<\/sup> December 2020.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/landlords-change-of-heart-leads-to-2400-fine\/wooden-gavel\/\" rel=\"attachment wp-att-5965\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter  wp-image-5965\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/10\/wooden-gavel.jpg\" alt=\"\" width=\"1226\" height=\"919\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/10\/wooden-gavel.jpg 1920w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/10\/wooden-gavel-700x525.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/10\/wooden-gavel-1100x825.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/10\/wooden-gavel-400x300.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/10\/wooden-gavel-768x576.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2021\/10\/wooden-gavel-1536x1152.jpg 1536w\" sizes=\"auto, (max-width: 1226px) 100vw, 1226px\" \/><\/a><\/p>\n<h4><strong>Radical change in intentions<\/strong><\/h4>\n<p>Although the landlord moved in to the property at the time it became vacant, he instructed an estate agent to market it for sale only 19 days after <a href=\"https:\/\/www.citylets.co.uk\/blog\/pre-eviction-protocols-to-be-made-permanent-post-pandemic\/\" target=\"_blank\" rel=\"noopener noreferrer\">taking possession<\/a>, and subsequently accepted an offer with a date of entry of 30<sup>th<\/sup> March 2021.<\/p>\n<p>At the telephone hearing where all parties appeared without representation, the First-tier Tribunal heard that the applicants were happy with their tenancy and wouldn\u2019t have left if it wasn\u2019t for the notice to leave that they had been served.<\/p>\n<p>The respondent when asked to demonstrate proof of his radical change in intentions from living in the property to selling it, could not \u201cgive a coherent explanation for such a significant change of heart.\u201d<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" target=\"_blank\" rel=\"attachment noopener wp-att-2791 noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>\u201cWhen asked a straightforward question, the respondent was evasive and prevaricated. The respondent blamed his financial difficulties; he then cited physical health problems, before finally blaming the Covid-19 pandemic,\u201d noted the Tribunal in its decision, and concluded:<\/p>\n<p>\u201cThe applicants only brought the tenancy of the property to an end because they received the notice to leave stating that the applicant wants to recover possession of the property so that he can use it as his own home. On the facts as we find them to be, 19 days after recovering the property the applicant marketed it for sale. The only realistic conclusion that we can reach is that the respondent misled the applicants, and, as a result of his misrepresentation, the applicants surrendered occupation of the property.\u201d<\/p>\n<p>The Tribunal ordered the landlord to pay three times the amount of the monthly rent to reflect the gravity of his actions.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Glasgow landlord has been fined \u00a32,400 for misleading his former tenants into surrendering occupation of a property which they wouldn\u2019t have left otherwise.
