{"id":6389,"date":"2022-06-14T10:26:47","date_gmt":"2022-06-14T10:26:47","guid":{"rendered":"https:\/\/www.citylets.co.uk\/blog\/?p=6389"},"modified":"2022-06-14T10:26:48","modified_gmt":"2022-06-14T10:26:48","slug":"properly-functioning-private-rented-sector-relies-on-equal-rights","status":"publish","type":"post","link":"https:\/\/www.citylets.co.uk\/blog\/properly-functioning-private-rented-sector-relies-on-equal-rights\/","title":{"rendered":"Properly Functioning Private Rented Sector Relies on Equal Rights"},"content":{"rendered":"<p>The Scottish Government\u2019s <a href=\"https:\/\/www.citylets.co.uk\/blog\/new-deal-for-tenants-goes-much-further-than-rent-controls\/\" target=\"_blank\" rel=\"noopener\">New Deal for Tenants<\/a> is, to coin a well-known advertising slogan, \u2018exactly what it says on the tin.\u2019<\/p>\n<p>The 108-page document contains the word \u2018tenants\u2019 289 times \u2014 over 100 times more than \u2018landlords\u2019 (165 times). \u2018Tenants\u2019 rights\u2019 outnumbers references to \u2018landlords\u2019 rights\u2019 by nine to one.<\/p>\n<p>So what, some might say. The strategy is, after all, ultimately designed to strengthen tenants\u2019 rights. However, the issue with that is simple: the two are not mutually exclusive. You can\u2019t have one without the other and tipping the balance too far in one direction will create a disproportionate impact on the other.<\/p>\n<p>That\u2019s what the Scottish Government is risking doing by meddling too much with a private rented sector that doesn\u2019t appear to be broken.<\/p>\n<p>Agents are in general agreement that there simply is not enough compelling evidence to support many of the changes being proposed. They believe the current system is functioning as it should.<\/p>\n<h4><strong>Let\u2019s take a closer look at some of the proposals<\/strong><\/h4>\n<p>Temporary changes to pre-action protocols were brought in at the start of the pandemic amid fears of mass evictions and piling up of rent arrears. There is no evidence that has happened. Indeed, agents&#8217; own data suggests in the past two years, notice to end tenancies instigated by landlords have been outnumbered by those from tenants by as many as eight to one.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/properly-functioning-private-rented-sector-relies-on-equal-rights\/to-let-board-sign-arla-resized\/\" rel=\"attachment wp-att-6394\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-6394\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/05\/To-let-board-sign-ARLA-resized-scaled.jpeg\" alt=\"\" width=\"2560\" height=\"1706\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/05\/To-let-board-sign-ARLA-resized-scaled.jpeg 2560w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/05\/To-let-board-sign-ARLA-resized-700x467.jpeg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/05\/To-let-board-sign-ARLA-resized-1100x733.jpeg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/05\/To-let-board-sign-ARLA-resized-400x267.jpeg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/05\/To-let-board-sign-ARLA-resized-768x512.jpeg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/05\/To-let-board-sign-ARLA-resized-1536x1024.jpeg 1536w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/05\/To-let-board-sign-ARLA-resized-2048x1365.jpeg 2048w\" sizes=\"auto, (max-width: 2560px) 100vw, 2560px\" \/><\/a><\/p>\n<p>The Scottish Government admits itself in the strategy document that limited research has been carried out on the impact of the PRT and the \u2018temporary\u2019 changes to grounds for possession brought in during the COVID-19 pandemic. So it\u2019s disappointing that its long-term reforms appear to signal the end of mandatory grounds without any hard evidence that it is needed.<\/p>\n<p>The ban on winter evictions that the strategy suggests is unworkable (in Scotland, some say winter runs from January to December!); the proposal to end joint tenancies will leave the remaining tenant in potential financial difficulty and turn private landlords into social landlords; there is no evidence anywhere in the world that rent controls or caps (however you want to describe them) work\u2026 Would it be a more effective use of unclaimed tenancy deposits to invest them in property to let long-term or supplement rent of proven victims of domestic abuse who remain in a tenancy, rather than to provide guaranteed deposits, as proposed?<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" target=\"_blank\" rel=\"attachment noopener wp-att-2791\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>The strategy also aims to provide greater flexibility for tenants to redecorate their homes and to have pets \u2013 but there\u2019s currently nothing to stop either. If a landlord has a good, long-term tenant surely they will allow that anyway?<\/p>\n<p>They say every cloud has a silver lining, and for letting agents and landlords it\u2019s the Scottish Government\u2019s own <a href=\"https:\/\/www.gov.scot\/news\/scottish-household-survey-2020-telephone-survey\/\" target=\"_blank\" rel=\"noopener\">Household Survey<\/a> that shows 94% of households in the private rented sector are \u2018very or fairly satisfied\u2019 with their housing.<\/p>\n<p>This will come as little surprise to those agents and landlords who will continue to argue that they are already working hard to elevate standards. Any further unwarranted burden that\u2019s placed on their shoulders may see some vote with their feet and withdraw from the PRS altogether.
