{"id":6914,"date":"2022-11-08T09:58:58","date_gmt":"2022-11-08T09:58:58","guid":{"rendered":"https:\/\/www.citylets.co.uk\/blog\/?p=6914"},"modified":"2022-11-08T09:58:59","modified_gmt":"2022-11-08T09:58:59","slug":"the-new-rent-arrears-ground-and-the-private-residential-tenancy","status":"publish","type":"post","link":"https:\/\/www.citylets.co.uk\/blog\/the-new-rent-arrears-ground-and-the-private-residential-tenancy\/","title":{"rendered":"The New Rent Arrears Ground and the Private Residential Tenancy"},"content":{"rendered":"<p>The Scottish Government passed the Cost of Living (Tenant Protection) (Scotland) Bill in early October and it came into force on 28th October 2022.<\/p>\n<p>The Bill provides <a href=\"https:\/\/www.citylets.co.uk\/blog\/the-cost-of-living-tenant-protection-scotland-act-2022\/\" target=\"_blank\" rel=\"noopener\">exemptions to the eviction moratorium<\/a> for new and existing grounds under both the assured and private residential tenancy regimes. This article focuses on the new rent arrears ground under the Private Residential Tenancy (PRT). The Bill introduces new ground 12A &#8211; \u201cit is an eviction ground that the tenant has substantial rent arrears\u201d.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/the-new-rent-arrears-ground-and-the-private-residential-tenancy\/scottish-parliament-tc-young\/\" rel=\"attachment wp-att-6926\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-6926\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/10\/Scottish-parliament-TC-Young.jpg\" alt=\"\" width=\"1920\" height=\"1272\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/10\/Scottish-parliament-TC-Young.jpg 1920w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/10\/Scottish-parliament-TC-Young-700x464.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/10\/Scottish-parliament-TC-Young-1100x729.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/10\/Scottish-parliament-TC-Young-400x265.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/10\/Scottish-parliament-TC-Young-768x509.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2022\/10\/Scottish-parliament-TC-Young-1536x1018.jpg 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><\/a><\/p>\n<h4><strong>What amounts to substantial rent arrears?<\/strong><\/h4>\n<p>In order to satisfy the ground, the tenant must have arrears of an amount equal to or greater than six months\u2019 rent under the tenancy. This is not a mandatory ground for eviction. Therefore, even if the tenant has this level of arrears and the ground can be satisfied, the Tribunal is still required to assess the <a href=\"https:\/\/www.citylets.co.uk\/blog\/eviction-grounds-and-reasonableness\/\" target=\"_blank\" rel=\"noopener\">reasonableness of eviction<\/a> which will include an assessment of the landlord\u2019s compliance with the pre-action protocol.<\/p>\n<h4><strong>I have already served notice on the existing rent arrears ground and my tenant has not vacated. The tenant\u2019s arrears are in excess of six months\u2019 rent now, can I raise a Tribunal application?<\/strong><\/h4>\n<p>The new Bill does not prevent a landlord relying on the existing rent arrears eviction ground or raising Tribunal proceedings on the basis of that ground. However, any proceedings raised after the Bill takes effect, on the basis of the existing ground, will be impacted by the eviction moratorium.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" target=\"_blank\" rel=\"attachment noopener wp-att-2791\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<p>This means a landlord will not be able to enforce the eviction for a period of six months from the date the Order is granted or the date the moratorium ends (whichever is earlier). The moratorium is scheduled to end on 31<sup>st<\/sup> March 2023.
