{"id":7803,"date":"2023-04-21T08:32:34","date_gmt":"2023-04-21T08:32:34","guid":{"rendered":"https:\/\/www.citylets.co.uk\/blog\/?p=7803"},"modified":"2023-04-21T08:32:35","modified_gmt":"2023-04-21T08:32:35","slug":"what-are-the-tax-charges-on-second-properties","status":"publish","type":"post","link":"https:\/\/www.citylets.co.uk\/blog\/what-are-the-tax-charges-on-second-properties\/","title":{"rendered":"What Are the Tax Charges on Second Properties?"},"content":{"rendered":"<p>If you are a landlord or second home owner in Scotland it is important that you are aware of the taxes you must pay when you purchase a buy-to-let property or holiday home.<\/p>\n<p>Nicky Lloyd, Head of ESPC Lettings, says: \u201cWhen buying a second home, the issue of tax can be overwhelming, but it is important to know your responsibilities as a landlord and be aware of the tax you are required to pay on your properties.&#8221;<\/p>\n<h4><strong>What is LBTT?<\/strong><\/h4>\n<p>Land and Buildings Transaction Tax (LBTT), Scotland\u2019s version of stamp duty, is a tax which applies to residential and commercial property purchases in Scotland.<\/p>\n<h4><strong>How much LBTT will I have to pay?<\/strong><\/h4>\n<p><a href=\"https:\/\/espc.com\/advice\/tools\/lbtt-calculator\" target=\"_blank\" rel=\"noopener\">The amount of LBTT you will pay on your residential property<\/a> will depend on how much it cost you to buy the property. There are also ADS charge exceptions available to spouses, civil partners and co-habitants who both have an existing home but want to buy a main property for them to live in together.<\/p>\n<p>If you are building a portfolio of six or more properties in a single or linked purchase, this type of transaction can be treated as non-residential and therefore avoids ADS.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" target=\"_blank\" rel=\"attachment noopener wp-att-2791\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<h4><strong>Income tax<\/strong><\/h4>\n<p>If you are a landlord in Scotland, the first \u00a31000 of your yearly rental income is tax free. This is called your \u2018property allowance.\u2019<\/p>\n<p>Allowable expenses you can claim include letting agency fees, utility and council bills paid by you, maintenance and repairs (but not renovating or improvements beyond wear and tear), <a href=\"https:\/\/www.citylets.co.uk\/landlord-services\/\" target=\"_blank\" rel=\"noopener\">property advertising<\/a> costs, accountancy fees and buildings and contents insurance.<\/p>\n<p>To work out how much income tax you owe, deduct all your allowable expenses for the year from your annual rental income. The net amount is the profit for the year which is taxable.<\/p>\n<p>The amount of tax you pay on your rental income will hinge on how much tax you pay on your other earnings. A basic rate taxpayer will pay 20% while a higher rate taxpayer will pay 41%.<\/p>\n<h4><strong>Capital Gains Tax<\/strong><\/h4>\n<p>If you own a buy-to-let portfolio, you will have to pay Capital Gains Tax (CGT) if you sell any of your rental properties.<\/p>\n<p>Any capital gain must be recorded in your self-assessment tax return for the tax year in which you sold the rental property.
