{"id":8101,"date":"2023-07-11T09:08:46","date_gmt":"2023-07-11T09:08:46","guid":{"rendered":"https:\/\/www.citylets.co.uk\/blog\/?p=8101"},"modified":"2023-07-11T09:08:47","modified_gmt":"2023-07-11T09:08:47","slug":"landlord-registration-appeals","status":"publish","type":"post","link":"https:\/\/www.citylets.co.uk\/blog\/landlord-registration-appeals\/","title":{"rendered":"Landlord Registration Appeals"},"content":{"rendered":"<h4><strong>The Fit and Proper Test<\/strong><\/h4>\n<p>In a <a href=\"https:\/\/scotcourts.gov.uk\/docs\/default-source\/cos-general-docs\/pdf-docs-for-opinions\/2023csoh40.pdf?sfvrsn=3addfbe9_1\" target=\"_blank\" rel=\"noopener\">recent judicial review<\/a> brought by private landlord, Anu Sharma, the Court of Session has provided useful clarification on the nature of the fit and proper person test to be applied by local authorities when determining whether or not to permit, refuse or remove a landlord from the register.<\/p>\n<p>In 2019 Ms Sharma was removed from the landlord register following <a href=\"https:\/\/www.citylets.co.uk\/flats-rent-renfrewshire\/1-bed-flats\/\" target=\"_blank\" rel=\"noopener\">Renfrewshire<\/a> Council\u2019s decision that she was not a fit and proper person. Ms Sharma appealed to the First-tier Tribunal (Housing and Property Chamber) (FTT) and then again to the Upper Tribunal (UT). She was unsuccessful in both cases.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/landlord-registration-appeals\/court-of-session-tc-young\/\" rel=\"attachment wp-att-8103\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-8103\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/07\/Court-of-Session-TC-Young.png\" alt=\"\" width=\"740\" height=\"467\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/07\/Court-of-Session-TC-Young.png 740w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/07\/Court-of-Session-TC-Young-700x442.png 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/07\/Court-of-Session-TC-Young-400x252.png 400w\" sizes=\"auto, (max-width: 740px) 100vw, 740px\" \/><\/a><\/p>\n<p>The appeal both to the FTT and the UT focused on what test should be applied when establishing a fit and proper person. The local authority, FTT and UT all proceeded on the basis that the test was whether or not the local authority considered the landlord to be a fit and proper person at the time of the decision (looking to the past history and existing position), whereas it was Ms Sharma\u2019s position that a forward looking approach should have been applied. This would involve consideration of the mitigations put in place to avoid future problems and consideration of whether there would be a recurrence of the behaviour of concern.<\/p>\n<p>The Court of Session determined that \u201cdecisions about registration generally look to the future\u201d. The UT had therefore erred in law.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/mobile\/\" target=\"_blank\" rel=\"attachment noopener wp-att-2791\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2791\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png\" alt=\"latest-apps\" width=\"618\" height=\"85\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps.png 618w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2017\/05\/latest-apps-400x55.png 400w\" sizes=\"auto, (max-width: 618px) 100vw, 618px\" \/><\/a><\/p>\n<h4><strong>Jurisdiction of the First-tier Tribunal<\/strong><\/h4>\n<p>This case also considered the jurisdiction of the FTT in connection with appealing the decision of local authorities where they have determined that a landlord is not fit and proper.
