{"id":9838,"date":"2025-03-13T08:40:05","date_gmt":"2025-03-13T08:40:05","guid":{"rendered":"https:\/\/www.citylets.co.uk\/blog\/?p=9838"},"modified":"2025-03-13T08:40:05","modified_gmt":"2025-03-13T08:40:05","slug":"rent-controls-whats-next","status":"publish","type":"post","link":"https:\/\/www.citylets.co.uk\/blog\/rent-controls-whats-next\/","title":{"rendered":"Rent Controls: What\u2019s next?"},"content":{"rendered":"<p><em>The Cost of Living (Tenant Protection) (Saving Provision) (Scotland) Regulations 2025<\/em><\/p>\n<p>Prior to the pandemic and cost of living crisis, rent increases were not subject to much attention in the Scottish PRS. This is because landlords rarely sought to increase the rent during a tenancy, often allowing the rent to remain the same for a number of years. When landlords did on the rare occasion seek to increase rent during the tenancy, the practical reality in the days of Short Assured Tenancy mandatory section 33 evictions were such that, if a rent increase could not be agreed, the landlord was able to terminate the tenancy with relative ease, and was entitled to do so. This goes some way to explaining why there is limited case law regarding rent increase provisions.<\/p>\n<p>Since 2020, various rent controls have been introduced, extended and repealed, with further changes proposed in the Housing (Scotland) Bill.<\/p>\n<p><a href=\"https:\/\/www.citylets.co.uk\/blog\/continuing-short-assured-tenancies\/gavel_blurred_background\/\" rel=\"attachment wp-att-7690\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-7690\" src=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/03\/gavel_blurred_background.jpg\" alt=\"\" width=\"1920\" height=\"1277\" srcset=\"https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/03\/gavel_blurred_background.jpg 1920w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/03\/gavel_blurred_background-700x466.jpg 700w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/03\/gavel_blurred_background-1100x732.jpg 1100w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/03\/gavel_blurred_background-400x266.jpg 400w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/03\/gavel_blurred_background-768x511.jpg 768w, https:\/\/www.citylets.co.uk\/blog\/wp-content\/uploads\/2023\/03\/gavel_blurred_background-1536x1022.jpg 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><\/a><\/p>\n<p>We are now almost a year since the introduction of temporary rent adjudication on 1<sup>st<\/sup> April 2024, which moved away from open market\u00a0rent\u00a0to a new tapering method of\u00a0rent\u00a0determination.<\/p>\n<p>On 7<sup>th<\/sup> February 2025, The Cost of Living (Tenant Protection) (Saving Provision) (Scotland) Regulations 2025 were laid before the Scottish Parliament, in terms of which the temporary \u2018tapering approach\u2019 will end, as originally planned, on 31<sup>st<\/sup> March 2025.<\/p>\n<p>The Housing (Scotland) Bill, which contains longer term rent control proposals, is currently at amendment Stage 2, meaning the proposals have not yet been finalised or become law. At the time of writing, we are not aware of any alternative transitionary measures to be adopted unless\/until the Housing (Scotland) Bill becomes law.<\/p>\n<p><strong>What does this mean for landlords\/letting agents?<\/strong><\/p>\n<p>Unless further temporary measures are introduced, landlords and agents can anticipate, from 1<sup>st<\/sup> April 2025, rent increases and adjudication will be based on the original rules contained within existing legislation. If a tenant challenges a proposed increase, the Rent Officer and\/or First-tier Tribunal will make rent determination based on the open market rent of the property without restriction.<\/p>\n<p>However, the 2025 Regulations do preserve the \u2018tapering\u2019 approach in relation to referrals made to the Rent Officer or First-tier Tribunal before 1<sup>st<\/sup> April 2025.
